Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 307, 323, 341, 504, 506 of the Indian Penal Code and Section 3(1)(x) of the SC & ST (Prevention of Atrocities) Act. It is alleged that petitioner assaulted and abused the informant by calling caste name for a dispute with regard to supply of toddy.

It is submitted by learned counsel for the petitioner that there was a free fight for a petty dispute and both sides received injuries and the injury of the informant has been found to be simple. Moreover there is counter version of the occurrence also.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

No.30384 of 2015 (2) dt.30-07-2015 2/2 The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with SC/ST P.S. Case No. 53 of 2015, pending in the Court of learned Chief Judicial Magistrate, Nalanda at Biharsharif. Accordingly the application is disposed off.
