====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-01-2022 Heard Mrs. Rina Sinha, learned Advocate for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner seeks bail in anticipation of his arrest in connection with Hajipur Town P. S. Case No. 388 of 2020 instituted for the offences under Sections 147, 148, 341, 323, 324, 325, 504, 506, 427, 354A and 379 of the Indian Penal Code.
There is an accusation in the F.I.R. against all the accused persons including the petitioner of having assaulted the members of the prosecution party and also of having damaged the property. So far as the petitioner is concerned, he is said to have damaged the motorcycle belonging to the informant. The other accused persons are alleged to have assaulted the
Patna High Court CR. MISC. No.28279 of 2021(2) dt.13-01-2022 2/2 informant, her daughter and other members of the family. The brother of petitioner no.2 is said to have filed a case earlier against the informant of the present case vide Hajipur Town P.S. Case No. 387 of 2020. The present case is only an off-shoot of the earlier case lodged by the brother of petitioner no.2.
The petitioners are agnates and there is a land dispute between them.
Regard being had to the afore-stated background facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 388 of 2020, subject to the condition as laid down under Section 438 (2) Cr. P.C.
The application stands allowed.
