JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-06-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 302 and some other ancillary Sections of the Indian Penal Code.

FIR has been instituted against as many as 19 named and 10-16 unknown persons.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case only on suspicion. It is submitted that except suspicion there is no objective material to connect this petitioner in the alleged occurrence. Similarly situated accused Avinash Singh, Manish Mahto, Ritu Raj, Lallu Rai and Battish Rai have already been granted anticipatory bail by different Benches of this court vide orders passed in Cr. Misc. No. 30654/2020,

Patna High Court CR. MISC. No.29497 of 2021(5) dt.20-06-2022 2/2 33802/ 2020, 35442/2020, 34145/2020 and 36510/2020 respectively.

Learned counsel appearing for the State opposes the prayer for anticipatory bail bail.

Considering the facts of the case and nature of accusation, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Sadar PS case No. 300/2020, subject to conditions laid down u/s 438(2) of the Cr. P. C. (Prabhat Kumar Singh, J) BKS/- U T
