2. In the present case, the petitioner seeks bail in connection with Bidupur P.S. Case No. 285 of 2019 registered on 10.07.2019 for the alleged offences under Sections 392 and 379 of the Indian Penal Code.
3. As per prosecution case, three miscreants on a motorcycle stopped the motorcycle of the informant and threatening him with a pistol, took away his motorcycle and one tablet of Samsung company apart from other articles in the motorcycle. The name of the petitioner transpired during investigation as one of the accused persons.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.18168 of 2023(2) dt.15-05-2023 2/3 petitioner is innocent and has been falsely implicated in this case. There is no specific allegation against the petitioner. No Test Identification Parade has been conducted in this case. The name of the petitioner came up in the confessional statement of co-accused Ajeet Kumar who has been granted bail by a Coordinate Bench of this Court vide order dated 22.02.2021 passed in Cr. Misc. No. 534 of 2021. Nothing incriminating has been recovered from the person or possession of the petitioner who has been remanded in this case on 01.11.2022 from some other case and charge-sheet has been submitted.
5. Learned APP opposes the prayer for bail submitting that petitioner is having a long criminal history and is accused in a number of cases of similar nature. At this stage, learned counsel for the petitioner submitted that petitioner has been made accused in four such cases after being remanded in the present case.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the fact that no recovery has been shown from this petitioner and further considering his period of custody and the submission of charge-sheet against him, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 20,000/-
Patna High Court CR. MISC. No.18168 of 2023(2) dt.15-05-2023 3/3 (twenty thousand) with two sureties of the like amount each to the satisfaction of learned court of Judicial Magistrate-Ist Class, Hajipur at Vaishali/court concerned in connection with Bidupur P.S. Case No. 285 of 2019, subject to the conditions mentioned in Section 437(3) of the Cr.P.C. and the following conditions: (i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
