Mr.Abhay Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-04-2019 Submission of the learned counsel for the petitioners is that petitioner no.1 Md. Shahabaz @ Shahabaz has been arrested.

In view of submission, the application against the the petitioner no.1 stands dismissed as withdrawn. Heard the parties.

The petitioners are apprehending their arrest in connection with Jamui (Town) P.S.Case no.18 of 2019 , registered for offences punishable under Sections 341, 323, 379, 307, 504/34 of the Indian Penal Code.

So far petitioner no.2 is concerned, allegation against the petitioner is of assault by rod.

Patna High Court CR. MISC. No.17209 of 2019(2) dt.01-04-2019 2/2 Submission of the learned counsel for the petitioner is that on the plain reading of the FIR there appears interpolation in that. The main allegation is against the other accused persons. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner no.2. Md. Sama, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Jamui in connection with Jamui (Town) P.S.Case no.18 of 2019, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid observation, this application is disposed of.
