Petitioner apprehends his arrest in a case filed under Section 392 of the Indian Penal Code.

It is submitted that F.I.R. is against unknown persons. It is also submitted that petitioner has not been put on any Test Identification Parade and nothing has been recovered from him. He has been implicated on the basis of self-incriminating confessional statement of co-accused, Mukesh yadav. Having regards to the facts and circumstances of the case, in the event of arrest/surrender within a period of six weeks from today in Tarabari P.S. Case No.65 of 2013, the above named petitioner, Sadman @ Md. Shadman shall be released on bail on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with

Patna High Court Cr.Misc. No.37235 of 2014 (2) dt.27-03-2015 2 / 2 two sureties of the like amount each to the satisfaction of Shri S.K. Mishra, Judicial Magistrate 1st Class, Araria subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.

That apart, in view of the fact that the petitioner is also involved in another case under Section 392 of the Indian Penal Code and in which anticipatory bail has been granted to him, he would be required to appear before the Superintendent of Police, Araria within fifteen days of his release with a copy of this order and every two weeks thereafter for the next six months. The conduct of the petitioner will be kept under watch in the aforesaid period by the Superintendent of Police concerned and if it is found wanting in any respect, a report shall be made to the court concerned by him to initiate a proceeding for cancellation of bail for reasons of misuse of bail. After reporting to the Superintendent of Police, a certificate will be filed by the petitioner before the court concerned which should be granted by the Superintendent of Police upon his appearance.
