JUSTICE SATYAVRAT VERMA ORAL ORDER 22-04-2022 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in a case registered for the offences punishable under Sections 30(a), 33 of the Excise Act, 2018.

The learned counsel for the petitioner submits that the petitioner is in custody since 28.02.2022, he is a person with clean antecedent and charge-sheet has been submitted in this case.

Allegation is of recovery of 560 litre of raw spirit from an Innova Car.

The learned counsel for the petitioner submits that petitioner was not arrested from the spot and his name transpired as he was owner of the said Innova car. It is

Patna High Court CR. MISC. No.18871 of 2022(2) dt.22-04-2022 2/2 submitted that petitioner had already sold the said car to one Vijay Kumar on 09.11.2019 i.e. much prior to the occurrence. Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent, charge-sheet has been submitted in this case and was not arrested from the spot, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Amba P. S. Case No.02 of 2022. The application stands allowed.
