Petitioner apprehends his arrest in a case registered for the offence punishable under Section 307 and some other allied Sections of the Indian Penal Code.
As per the prosecution case, petitioner is alleged to have assaulted on right elbow of the informant with spade. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. The injury found on the informant is reported to be simple in nature. Petitioner is neither driver nor owner of the Tempu in question. Petitioner has got clean antecedent. Learned counsel appearing for the State opposes the prayer for anticipatory bail bail.
Considering the facts of the case and clean antecedent
Patna High Court CR. MISC. No.29544 of 2021(3) dt.20-06-2022 2/2 of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Arwal, Jehanabad in connection with Parasi PS case No.53/2019, subject to conditions laid down u/s 438(2) of the Cr.
