Petitioner is in custody in connection with Excise Case No. 04 of 2019 for the offence under section 30(a) of Bihar Prohibition and Excise Act.

Learned counsel for the petitioner would submit that petitioner is a lady. She has no criminal antecedent and in the instant case total 293.760 liters of liquor was seized from the Khalihan of the petitioner and not from the exclusive possession of the petitioner.

The Petitioner is in custody since 28.1.2019. Considering the fact that petitioner is a lady. She is in custody since 28.1.2019 and the recovery was made from the

Patna High Court CR. MISC. No.17856 of 2019(2) dt.26-03-2019 2/2 Khalihan of the petitioner and not from the exclusive possession of the petitioner, the court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District and Sessions Judge cum Special Judge Excise, Rohtas at Sasaram, in connection with Excise Case No. 04 of 2019.
