Petitioner seeks anticipatory bail in a case registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.
Recovery is of 90 liters of illicit country made liquor from the paddy field of this petitioner.
Learned counsel appearing for the petitioner submits that the petitioner has falsely been implicated in the present case. He further submits that it appears from the FIR that 90 liters of country made liquor is said to be recovered from the paddy field of the petitioner which is an open place. He further submits that nothing has been recovered from conscious possession of the petitioner. Petitioner has got clean antecedent.
Patna High Court CR. MISC. No.18434 of 2022(2) dt.22-07-2022 2/2 Learned A.P.P. for the State has opposed the prayer for bail of the petitioner.
Considering the facts and circumstances of the case and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act-II, Muzaffarpur in connection with Paroo P.S. Case No.439 of 2021, subject to condition as laid down u/s 438 (2) of the Cr. P. C.
