2. The petitioner apprehends his arrest in a case registered for the offence under Sections 279, 304A, 427 of the Indian Penal Code and later on Section 304 IPC is added.

3. As per the prosecution case, the allegation is that driver of an I10 car bearing Registration No. BR-1AH-9293 while driving the vehicle rashly and negligently dashed the son of the informant due to which he died on 13.03.2023.

4. Learned counsel for the petitioner submits that that the petitioner is not named in the F.I.R. and during the course of investigation, his name has been transpired. Petitioner has got no concern with the vehicle having Registration No.BR1AH-9293 and he is neither onwer nor driver of the vehicle in question. The vehicle in question was seized from the spot is

Patna High Court CR. MISC. No.21743 of 2024(3) dt.09-07-2024 2/2 having Registration No. DL1CJ 7604 which is different from the details of the vehicle stated by the informant in the F.I.R.

5. Learned A.P.P. for the State has opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest or surrender within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Patna, in connection with Traffic P.S. Case (Gandhi Maidan, Patna) No. 30 of 2023, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
