This application is for grant of regular bail in connection with Tajpur (Halai) P.S.Case No.244 of 2017 for the offences punishable under Sections 394 and 411 of the Indian Penal Code.

Petitioner is not named in the FIR and it appear that later on, on information of the informant, the police through GPS located the location of the vehicle and the petitioner was apprehended while fleeing from the looted vehicle. Submission of the learned counsel for the petitioner is that he has no criminal antecedent and he is in custody for about three months and he has also been falsely implicated in this case. Heard learned A.P.P. also, who has opposed the

Patna High Court Cr.Misc. No.61978 of 2017 (3) dt.11-01-2018 2/2 prayer for bail.

Having heard both sides and in view of facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, considering the fact that he has no criminal antecedent and once the charge is framed, the learned trial court shall release the petitioner on bail on filing an undertaking that he will co-operate in disposal of the trial and shall appear as and when required by the court concerned . With the aforesaid observation, this application is disposed of.
