The petitioner is in judicial custody in connection with S.T. No. 40/2022 arising out of Chautham P.S. Case No. 196 of 2021 for the offences under Section 395 of the Indian Penal Code and subsequently Section 412 of the Indian Penal Code was added.
As per the allegation in the FIR, the petitioner along with other accused persons committed dacoity in the house of the informant and it is alleged that altogether Rs. 3 lakh 50 thousand as well as ornaments were looted.
Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.18701 of 2022(3) dt.30-08-2022 2/2 because he has criminal antecedent, (eight cases of almost same nature) he has been implicated in this case.
Per contra, Mr. Jitendra Kumar Singh, learned APP for the State submits that pursuant to the investigation, there has been recovery from the house of petitioner of the looted articles. Taking into account the fact that the looted articles have been recovered from the house of the petitioner and he has criminal antecedent, this Court is not inclined to grant him privilege of bail for the present which is accordingly, rejected. The Trial Court is hereby directed to expedite the trial and conclude the same preferably within a period of nine months.
