JUSTICE ARUN KUMAR ORAL ORDER 16-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Minapur PS Case No. 85 of 2017 (Sessions Trial No. 551 of 2017) registered under Sections 302/34 of the IPC.

Learned Counsel for the petitioner submits that the petitioner is agnate of the deceased and all family members have been implicated in this case. There is no specific allegation against the petitioner, it is only alleged that the accused persons took her to nearby orchard and assaulted. The alleged occurrence is dated 24.3.2017 and the informant's husband died after two days, meanwhile he was not treated anywhere else and died due to some injury sustained later on. Due to land dispute the petitioner was implicated in this case, he is in custody since 30.4.2017 and has clean antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Bhadai Ram is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of VIth Additional Sessions Judge Muzaffarpur in connection with Minapur PS Case No. 85 of 2017 (Sessions Trial No. 551 of 2017).
