The petitioner seeks regular bail in connection with Aanti P.S. Case No.25 of 2016 registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code. The petitioner is in-charge Headmaster of Middle School, Mithapur, Konch (Gaya). He was provided with an amount of Rs.6,56,000/- for construction of school building for the financial year 2008-09. This petitioner performed construction work worth Rs.3,23,856/- and misappropriated an amount of Rs.3,32,144/-. The learned counsel for the petitioner submits that on account of scarcity of sand, the work could not be completed in time and the
Patna High Court Cr.Misc. No.60655 of 2017 (2) dt.19-12-2017 present case was lodged. The petitioner has annexed letter no.1783 dated 31.08.2017 issued by the District Programme Officer to show that as per letter he has already performed the work for an amount of Rs.5,85,791/- and the same is at the stage of finishing. The petitioner is in custody since 30.10.2017 having clean antecedent.
The learned A.P.P. for the State opposed the submission. Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of the learned Judicial Magistrate,1st Class, Gaya in connection with Anti P.S. Case No.25 of 2016.
