The petitioner apprehends his arrest in connection with Patrakar Nagar P.S. Case No. 161 of 2013 for the offences punishable under Sections 457 and 380 of Indian Penal Code. The F.I.R. charges unknown accused of committing house trespass and theft in the premises of the informant which also includes a mobile phone. The allegation against this petitioner is that the sim card allotted in the name of the petitioner was found to be used in the said mobile.
Mr. Ashok Kumar Mishra, learned counsel for the petitioner has submitted that the said mobile phone had been purchased by the petitioner who is student, from one Vikash Kumar and who has himself given a certification to that effect which is placed at
Patna High Court Cr.Misc. No.38815 of 2014 (2) dt.20-03-2015 2 / 2 Annexure-3. He further submits that apart from the said circumstances there is nothing to connect the petitioner with the alleged offence.
Having heard learned counsel for the parties, let the petitioner namely, Chandan Kumar Choudhary in the event of his arrest/surrender within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna in connection with Patrakar Nagar P.S. Case No. 161 of 2013 subject to the conditions stipulated under Section 438(2) of the Code of Criminal Procedure.
