JUSTICE SATYAVRAT VERMA ORAL ORDER 15-04-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Sections 30(a) and 37(b) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 08.02.2022, is a person with clean antecedent and charge-sheet has been submitted in the case. Allegation is of recovery of 40 litres of liquor kept in a plastic bag from the house of the petitioner. Learned counsel for the petitioner submits that the house is a joint family property and as such petitioner was not knowing who had kept the liquor in the house. Learned A.P.P. for the State opposes the prayer for

Patna High Court CR. MISC. No.18212 of 2022(2) dt.15-04-2022 2/2 bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 1,000/- (Rupees One Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Roh P.S. Case No. 38 of 2022.
