The petitioner has preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code.

As per the prosecution case, four accused persons on two motorcycles are stated to have snatched the bag of the informant containing his laptop etc.

It is submitted by learned counsel for the petitioner that the F.I.R. was registered against four unknown. The name of the petitioner transpired in course of investigation. Referring to the order of the learned court below, it is submitted that the material which has transpired in course of investigation has been dealt with in detail by the learned court below in it's order from which it appears that the materials being relied on to

No.28501 of 2021(3) dt.08-12-2021 2/2 implicate the petitioner are the recovery of the Adhaar Card of the informant from the dickey of the motorcycle of the petitioner, the confessional statement of the petitioner and the confessional statement of a co-accused made before police. It is submitted that no incriminating article has been recovered from the petitioner's possession who is in custody since 21.12.2020 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for over 11 months, the Court directs the petitioner to be enlarged on bail in connection with Azamnagar P.S. Case no.308 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar.
