====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-04-2025 Heard learned counsel for the petitioner and the State.

2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 196 and 299 of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, petitioner is alleged to have spoken filthy words in the class room with intention to offend religion or religious beliefs due to which a feeling of hatred and communal tension may arise between two communities.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is submitted that petitioner is a very responsible and educated person and is in teaching profession since 2016. One Rajesh Poddar, father of a girl who was studying in the school in question, has given an application to

Patna High Court CR. MISC. No.19707 of 2025(2) dt.19-04-2025 2/2 the SHO, Bachhwara to withdraw his earlier complaint and also said that he is not concerned with the contents written in the complaint. Petitioner claims clean antecedent.

5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in Bachhwara Police Station Case No. 350 of 2024, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
