JUSTICE SUDHIR SINGH ORAL ORDER 30-07-2015 The petitioners are apprehending their arrest in connection with Pirpainty P.S. Case No. 259 of 2014 for the offence under Sections 147, 149, 341, 323, 307, 427, 384 and 504 of the Indian Penal Code.

Heard learned counsel for the petitioners and the State.

The prosecution story, in brief, is that petitioners assaulted the three sons of the informant with lathi and danda due to grazing of the cattle. The crop of Rs. 5,000/- have been destroyed. The petitioners were demanding Rs. 20,000/- as ransom.

It is submitted on behalf of the petitioners that the

Patna High Court Cr.Misc. No.30663 of 2015 (2) dt.30-07-2015 petitioners have got no criminal antecedent. It is case and counter case. Injuries received by the informant's side are simple in nature. Injuries received on the petitioners' side have not been explained by the prosecution.

On behalf of the State, it has been submitted that the petitioners are named in the First Information Report. Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bhagalpur in connection with Pirpainty P.S. Case No. 259 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
