JUSTICE MADHURESH PRASAD ORAL ORDER 07-02-2018 Heard counsel for the petitioners and the State. Petitioners are accused in a case registered for offence under sections 363/365 IPC.
Counsel for the petitioners with reference to the case diary submits that the independent witnesses have not supported the allegation and the FIR was lodged after inordinate delay. Petitioner has no antecedent and he is in custody since 29.8.2017.
Considering the aforesaid submissions, prayer for bail of both the petitioners is allowed. Let the petitioners, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- each each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran, Motihari in Pipra Police Station Case No. 122 of 2010 on the following conditions:- (a) One of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how they are related with the petitioners. (b) The petitioners will be well represented on each date and if fails to do so on two consecutive dates, his bail will be liable to be cancelled.
