JUSTICE ARUN KUMAR ORAL ORDER 24-01-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Harpur P.S.Case No. 12 of 2017 registered under Sections 302 and 120B of the Indian penal Code.

Allegation in brief is that the husband and all his family members have brutally assaulted the informant's daughter and killed her.

Patna High Court Cr.Misc. No.59560 of 2017 (3) dt.24-01-2018 2/2 Submission is that petitioner Sudin Kumar @ Sudin Bind is the elder brother of the husband of the deceased and in the case diary evidence is that deceased husband had illicit relation with another lady so his wife used to quarrel with him and being frustrated she committed suicide by taking poison and viscera has been sent for examination to the Forensic Science Laboratory and except injuries on fingers of right leg, no other external injury was found on the deceased and police has submitted charge sheet in this case.

Having considered the aforesaid facts and circumstances, the petitioner, namely , Sudin Kumar @ Sudin bind is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Munger in connection with Harpur P.S. Case No. 12 of 2017.

However, considering the aforesaid facts and circumstances, prayer for bail of petitioner Sudarshan Bind-husband of the deceased is rejected.
