The petitioner is apprehending his arrest in connection with Motipur P.S. Case No. 392/2022 dated 04.11.2022, registered for the offence punishable under Sections 323, 354(B), 376 and 511 pending in the Court of learned A.C.J.M.- 2nd (West), Muzaffarpur.

After some arguments, learned counsel for the petitioner seeks permission to withdraw this application. Permission is granted.

Accordingly, the instant application is dismissed as withdrawn.

However, if the petitioner surrenders before the learned Court below within a period of six weeks from today

Patna High Court CR. MISC. No.18672 of 2023(3) dt.23-06-2023 2/2 and seeks regular bail, the learned Court below would pass the order, preferably, on the same day, without being prejudiced by this order.
