Petitioner seeks regular bail in connection with Birpur PS Case No. 132/2019 registered for the offence punishable under Section 25(1-b)a/26/35 of the Arms Act. The allegation, as per First Information Report against the petitioner, is that one loaded country made pistol, two live cartridges along with a mobile have been recovered from possession of the petitioner.
Learned counsel for the petitioner submits that petitioner has got no criminal antecedents and he has falsely been implicated in this case by the police with oblique motive. He further submits that petitioner is in custody since 20.10.2019
Patna High Court CR. MISC. No.28152 of 2021(2) dt.06-12-2021 2/2 and another co-accused, namely, Md. Shahabuddin has been granted bail by a co-ordinate Bench of this Court vide Cr. Misc. No. 22814/2020. Learned counsel for the petitioner next submits that charge-sheet has already been submitted and the present case is triable by the Magistrate.
Regard being had to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner has got no criminal antecedents, another co-accused, Md. Shahabuddin has already been granted bail by this Court and petitioner is in custody since 20.10.2019, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, SUJEET KUMAR be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Begusarai in connection with Birpur PS Case No. 132/2019.
