The petitioner seeks Anticipatory bail in connection with Gopalganj Nagar P.S. Case No. 241 of 2018 registered under Sections 341, 323, 307, 504/34 of the Indian Penal Code. Allegation against the petitioner and another coaccused is that petitioners dashed their motorcycle on person of informant and abused him and also assaulted by lathi-danda. It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated in this case. It has been further submitted that the entire allegation is baseless and levelled against petitioner is false because sister-inlaw of the informant was in love with the petitioner and they solemnized their marriage and are living as husband and wife. This was inter-caste marriage due to this reason the informant was searching an opportunity to implicate the petitioner in false

Patna High Court Cr.Misc. No.48101 of 2018(2) dt.17-09-2018 2/2 case. Informant sustained injuries in an accident and he implicated the petitioner in false case. It has been further submitted that occurrence took place on 15.05.2018 and information to the police was given on 22.05.2018 without any explanation of such delay which creates strong doubt on the genuineness of the occurrence. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case, prayer of Anticipatory bail is allowed and petitioner named above in the event of arrest or surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gopalganj, in connection with Gopalganj Nagar P.S. Case No. 241 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
