====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-04-2025 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 115(2), 126(2), 109, 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution case, all the FIR named accused persons including these petitioners assaulted the informant with lathi, danda and iron rod causing him injuries.
4. It is submitted on behalf of the petitioners that petitioners and informant are brothers and there is land dispute between them. Allegation of assault is general and omnibus and no specific overt act has been alleged against these petitioners.
Patna High Court CR. MISC. No.17617 of 2025(2) dt.09-04-2025 2/2 Doctor has found simple injury. Petitioners claim clean antecedent.
5. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within eight weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Begusarai in Phulwariya Police Station Case No. 210 of 2024, subject to the conditions laid down under section 482 of the the Bharatiya Nagarik Suraksha Sanhita, 2023.
