The petitioner seeks bail in Kankarbagh P.S. Case No. 148 of 2017 registered under Section 394 of the Indian Penal Code.

The petitioner along with several accused persons is said to have looted cash of Rs. 6000/- and other belongings of the informant on the way to his house.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. There is nothing in the record indicating the complicity of the petitioner in the occurrence barring confessional statement of the co-accused Md. Arman and

Patna High Court Cr.Misc. No.53644 of 2017 (2) dt.09-11-2017 2/2 the petitioner which has no evidentiary value in the eye of law. The petitioner has been languishing in custody since 18.07.2017. Co-accused, namely, Subodh Kumar has been enlarged on bail by a co-ordinate bench of this court vide order dated 06.09.2017 passed in Cr. Misc. No. 42546 of 2017 and modification order dated 13.09.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Patna in connection with Kankarbagh P.S.
