The petitioner apprehends his arrest in a case under Section 384, 387/34 of the Indian Penal Code and Section 3⁄4 of the Explosive Substance Act.

The petitioner is not named in the FIR. The name of petitioner figured in the case during the course of investigation. Other accused persons have already been acquitted after trial. The petitioner did not appear in the court during the trial and after more than four years the petitioner moved for anticipatory bail. Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.

The petitioner may surrender in the court below, i.e.,

Patna High Court Cr.Misc. No.29471 of 2015 (2) dt.27-07-2014 2/2 learned Chief Judicial Magistrate, Jamui in Sikandra P.S. case No. 17/2011 and pray for regular bail. The court below shall consider the prayer for regular bail of the petitioner taking into consideration that all other accused persons have already been acquitted.
