JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-10-2019 This case has been listed today under the heading "To Be Mentioned" at the instance of the petitioner. Submission of learned counsel for the petitioner is that vide order dated 04.09.2019, the prayer for anticipatory bail of the petitioner was disposed of and there was direction to surrender in the court below on 16.09.2019, however, in the said order the date of surrender has inadvertently been recorded as 16.08.2019, which appears to be an apparent error as the date of order itself is 04.09.2019.
Considering the submission of learned counsel for the petitioner as well as from perusal of the order dated 04.09.2019, it appears that an apparent error has occurred as there was
Patna High Court CR. MISC. No.23193 of 2019(8) dt.23-10-2019 2/2 direction to the petitioner and opposite party no. 2 appear in the court below by 16.09.2019 but it has inadvertently been recorded as 16.08.2019.
In such view of the matter, order dated 04.09.2019 is modified to the extent that petitioner is directed to surrender in the court below on 14.11.2019, on which date, opposite party no. 2 shall also remain present.
All other parts of the order dated 04.09.2019 shall remain intact.
Let a copy of this order be communicated to the concerned court below forthwith.
