JUSTICE SATYAVRAT VERMA ORAL ORDER 23-12-2021 Heard learned counsel for the petitioner and Shri Rabindra Kumar, learned A.P.P. for the State. The petitioner seeks regular bail in connection with Karza P.S. Case No. 35 of 2020 instituted for the offences under Sections 498A, 307, 34 and 302 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 08.12.2020, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that informant (deceased) alleged that she was married to Rajan Pandey and after marriage, the family members of the husband including him were demanding motorcycle as dowry but the father of the informant was not in a position to fulfill the demand. Patna High Court CR. MISC. No.29958 of 2021(3) dt.23-12-2021 2/2 fulfilled and it is alleged that this petitioner ordered the accused to kill her and the mother-in-law, on orders, provided a gallon of kerosene oil in hands of husband of the deceased who poured the kerosene oil and set her on fire.

Learned counsel for the petitioner submits that petitioner is the father-in-law of the deceased and he is alleged to be an order giver and the husband of the deceased is in custody.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 08.12.2020, he is the father-in-law, the husband is in custody, charge-sheet has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-V, (West), Muzaffarpur in connection with Karza P.S. Case No. 35 of 2020.
