The petitioner seeks bail in a case registered for the offence under Section 302, 34 of the Indian Penal Code. In the F.I.R., it is alleged that all the F.I.R. named accused persons including this petitioner, on account of previous dispute, killed the father of the informant.

It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case only on suspicion and on account of previous enmity. There is no eye-witness to the occurrence. Similarly situated co-accused namely Ishaad Ali and Mukhtar have already been granted bail by a coordinate Bench of this Court, vide order dated 22.02.2022 passed in Cr.Misc. No. 55790 of 2021 (Annexure 2). Petitioner has got clean antecedent and he is in custody since 20.06.2021.

Patna High Court CR. MISC. No.18381 of 2022(2) dt.26-05-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Katihar in connection with Sessions Trial No. 335 of 2021, arising out of Abadpur P.S. Case No. 53 of 2021.
