ANJANA MISHRA ORAL ORDER 14-08-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 341, 323, 307 and 302/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the allegation against the petitioner is that he had participated in an occurrence leading to the death of the son of the informant which is wholly misconceived as the petitioner had already left the village on the said date. It is submitted that the petitioner though not named in the FIR, subsequently, his name has been added only because the father of the petitioner had filed a title suit against the informant. Considering the aforementioned fact and also the fact that the petitioner has no criminal antecedent, let the petitioner

No.31716 of 2015 (2) dt.14-08-2015 P2/2 Sudhakar Sharma, in the event of his arrest / surrender within a period of three weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Guthani P.S. Case No. 118/2014 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
