The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

284.280 liters of illicit foreign liquor has been recovered from a Tempo and name of petitioner has transpired during course of investigation.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Petitioner is neither owner nor driver of the said tempo and has got clean antecedent.

Considering the nature of allegation and clean antecedent of petitioner, let the above named petitioner, in the

Patna High Court CR. MISC. No.18293 of 2022(2) dt.22-07-2022 2/2 event of his arrest or surrender within a period of six weeks from the date of receipt / production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 2, Gaya in connection with Sherghati P.S. Case No. 235 of 2021, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
