2. The petitioner is in custody in connection with Nawalpur P.S Case No. 67 of 2024 registered for the offences punishable under Sections 126(2), 115(2), 118(1), 117(2), 109, 303(2), 352, 3(5) of B.N.S 2023.

3. As per prosecution case, it is alleged that petitioner along with co-accused have assaulted the informant by means of iron rod and looted Rs. 15,000/-.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further submitted that petitioner is an innocent. It is also submitted that petitioner is in judicial custody since 20.01.2025.

5. However, learned APP for the State and learned counsel for the informant opposed the prayer for regular bail of the petitioner.

6. On perusal of the FIR and impugned order dated 19.02.2025 it appears that there is only allegation against the petitioner is to have assaulted the informant on his head by means of iron rod while in injury report there is only three injuries found on the leg of the informant-cum-injured. Two accused have already granted anticipatory bail by the Coordinate Bench of this Court in Cr. Misc. No. 84285 of 2024 vide order dated 16.12.2024.

7. Considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M, Bettiah, West Champaran in connection with Nawalpur P.S Case No. 67 of 2024.
