The present petition has been preferred for quashing of the FIR bearing Siswan PS Case No. 161/2016 as well as its entire investigation registered for the offence under sections 174, 188, 420, 406, 406, 120(B) of the IPC and section 7 of the EC Act pending in the court of learned Chief Judicial Magistrate, Siwan.

3. A counter affidavit has been filed on behalf of the State duly filed by the Superintendent of Police, according to which, the final order has been passed on the basis of materials available on record.

4. Learned counsel for the petitioner submits that in the changed circumstance, he may be permitted to withdraw the
