JUSTICE BIRENDRA KUMAR ORAL ORDER 03-01-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Jandaha P.S. Case No.64 of 2015, a case under Sections 498A/304B/34 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act. Subsequently, charge sheet was submitted under Sections 498A, 302/34 and 304B/34 of the Indian Penal Code.

The petitioner is husband of the alleged victim of dowry death. The petitioner is in custody since 23.11.2015. Earlier prayer for bail was refused on 15.03.2017 in Cr. Misc. No.2753 of 2017. However, the order of the learned trial Judge would reveal that no prosecution witness has been

Patna High Court Cr.Misc. No.60467 of 2017 (2) dt.03-01-2018 P2/ examined uptil now in Sessions Trial No.117 of 2016 pending in the Court of Additional Sessions Judge-VI, Vaishali at Hajipur. In the circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below, where the case is pending in connection with the aforesaid case, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
