JUSTICE SANJAY PRIYA ORAL ORDER 2/` 25-09-2018 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners seek bail in Motipur P.S. Case No.265 of 2018 instituted for the offence under Section(s) 399, 402 Indian Penal Code and Sections 25(1-b), 26, 35 of the Arms Act. It is alleged that one motorcycle and one mobile have been recovered from the possession of petitioner No.1. From the possession of petitioner No.2, two live cartridges were recovered.

Counsel for the petitioners submits that motorcycle as well as mobile belongs to the petitioner No.1. He is having valid papers in respect of the motorcycle.

Patna High Court Cr.Misc. No.49044 of 2018 (2) dt.25-09-2018 2/2 It has further been submitted that co-accused, Ranjan Kumar @ Sonu @ Rajan Kumar, has been granted bail by co-ordinate Bench of this Court by order dated 30.08.2018 passed in Cr. Misc. No.50309 of 2018.

In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, West, Muzaffapur, in connection with Motipur P.S. Case No.265 of 2018, subject to the condition that both the bailors shall be close relative of the petitioners. (Sanjay Priya, J) JA/- Rohit Kr.
