====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 03-02-2022 Heard the parties through video conferencing. Heard learned counsel appearing on behalf of the petitioner and learned A.P.P. for the State.

Let the defect(s), if any, be removed within two weeks of the complete start of the physical Court in normal course.

The petitioner, who is in custody since 03.08.2020, seeks regular bail in connection with Beldaur P.S. Case No. 209 of 2020 for the offence punishable under Sections 328, 302 and 201 of the Indian Penal Code.

The allegation against the petitioner who is the husband of the deceased is that after quarrel he has administered poison to his wife and it was seen by his parental aunt (phua) who had informed the police on telephone that after committing murder of his wife with an intent to dispose of the body, the

The said fact has come in Paragraph No.27 of the case diary in which 'phua' of the petitioner namely Shobha Devi has made her statement under Section 161 Cr.P.C. that the petitioner used to quarrel with his wife and tortured her on several occasions. The petitioner is also having four wives and he never cared the deceased.

Considering the serious allegation made against the petitioner against whom allegation of committing murder of his own wife has been supported by several independent witnesses in course of investigation, I am not inclined to enlarge the petitioner on bail.

Accordingly, the present bail application is rejected. The trial court is directed to conclude the trial expeditiously.

If no substantial progress takes place in the trial during the considerable period, the petitioner, if so advised, may renew his prayer for bail.
