Petitioners apprehend their arrest in Tekari P.S. Case No. 89 of 2018 instituted for the offense under Sections 341, 323, 504, 506, 307 and 379/34 of the Indian Penal Code.
Learned counsel for the petitioners has submitted there is delay of 19 days from the date of occurrence in lodging the case for which no valid explanation has been given by the informant. In the
Patna High Court Cr.Misc. No.40070 of 2018(3) dt.27-07-2018 2/3 written report it is alleged that petitioners Nos. 1 and 2 assaulted the grandson of the informant on the testicles and chest and pushed him down on the ground and also snatched the locket from his neck. Learned counsel for the petitioners has submitted that the doctor has found no external injury over the body of the informant's grandson. The case diary has been received.
Learned APP has submitted that in the case diary injury report of the informant's grandson has been available, wherein, it is mentioned that doctor did not find any external injury. There is no any allegation of specific overt act against petitioners Nos. 3, 4 and 5. In the facts and circumstances of the case, prayer of the petitioners for grant of anticipatory bail is allowed. In the event of surrender/arrest of the petitioners, named above, within six weeks from today in connection with Tekari P.S. Case No. 89 of 2018 , they shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M., VI, Gaya, subject to the conditions as laid down under Section 438(2) Cr. P.C.
