The petitioner seeks bail, who is in custody since 24.08.2022 in connection with Rajauli P.S. Case No. 139 of 2021, F.I.R. dated 22.03.2021 registered for the offence punishable under Section 304(B)of the Indian Penal Code. As per the prosecution case, this petitioner and his family members killed the informant's daughter for nonfulfillment of demand of dowry. Learned counsel appearing for the petitioner submits that the petitioner has clean antecedent. He has falsely been implicated in the present case. Further submits that the allegation as alleged in the FIR is false and fabricated and the petitioner has not committed any offence as alleged in the FIR.
Patna High Court CR. MISC. No.18579 of 2023(3) dt.04-07-2023 2/2 Learned APP for the State, on the basis of the material available on the record and the case diary, has vehemently opposed the prayer for bail of the petitioner and submits that as per FIR allegation against the petitioner is that he committed murder of his wife and the postmortem report also supports the allegation as alleged in the FIR.
Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail in connection with Rajauli P.S. Case No. 139 of 2021 pending in the court of learned Chief Judicial Magistrate, Nawada.
Prayer is refused.
