In pursuance to the direction of this Court, a report with regard to the present stage of trial has been received which has been kept at Flag 'A'.

The report of learned 1st Additional Sessions Judgecum-Special Judge, Sitamarhi dated 22.05.2023 suggests that during trial two prosecution witnesses have been examined and six prosecution witnesses including Doctor and I.O. are yet to be examined in the case by the prosecution, for which summons have already been issued against them.

In that view of the matter, learned counsel for the petitioner seeks permission to withdraw the petition after making some submission.

Permission is accorded.
