JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-06-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Sessions Trial No. 687 of 2019 arising out of Kesariya P.S. Case No. 33 of 2016 for the offenses under Sections 341, 323, 324, 307, 384, 353, 379, 504 and 506 of the Indian Penal Code. Learned counsel for the petitioner would submit that the incident took place on account of scuffle between the petitioner and the informant when the informant passed vulgar comment on petitioner's wife. The injury sustained by the informant is simple in nature. The petitioner is in custody since 21.7.2019.

Considering the period of custody, the Court is

Patna High Court CR. MISC. No.17680 of 2020(2) dt.03-06-2020 2/2 inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the 3rd Additional Sessions Judge, East Champaran at Motihari in connection with Sessions Trial No. 687 of 2019 arising out of Kesariya P.S. Case No. 33 of 2016, subject to the condition that on release the petitioner shall render his services as volunteer to combat the pandemic of Covid-19 for a period of two months. He is required to report to the Civil Surgeon/ Nodal Officer, Covid-19, East Champaran at Motihari who shall utilize his services appropriately. (Anil Kumar Upadhyay, J) spandey/- U T
