JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-10-2018 The petitioner is in custody since 29.05.2018 in connection with Sabour P.S. Case No. 376 of 2017, registered for offences punishable under Sections 341, 307, 384, 387, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act. Submission of learned counsel for the petitioner is that he has demanded Rangdari from the partner of the informant and also allegation of firing, which did not hit anybody. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and he is a labour and for several months the petitioner had not received the back wages and when the petitioner demanded the same, then he had ousted from the work and also made accused in this case. The petitioner is in custody since 29.05.2018 and having no criminal antecedents. Heard learned A.P.P. also.
Having heard both sides and considering the
Patna High Court Cr.Misc. No.48354 of 2018 (2) dt.01-10-2018 2/2 aforementioned facts and circumstances, learned Trial Court is directed to verify the criminal antecedents of the petitioner and if no criminal antecedent is found against the petitioner, the concerned court below shall enlarge the petitioner on bail to his own satisfaction.
