The petitioner is in judicial custody in connection with Panjwara P.S. Case No. 79 of 2019 for the offences under Sections 304(B), 120B and 34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.

As per the FIR, the informant has alleged that his daughter was married five years ago with the present petitioner but was tortured right since the marriage. On 19.07.2019, the informant came to know that his daughter has been assaulted by the accused persons and later got information that she has been strangulated to death.

Case No. 79 of 2019 and the petitioner, who is husband of the deceased, despite the knowledge of the death and the lodging of the FIR chose to come into judicial custody on 22.12.2021 (as stated in paragraph-16 of the bail application). Considering the fact that the petitioner is the husband, who cannot exonerate his responsibility, evaded arrest for two and half years, this Court is not inclined to grant him the privilege of bail which is accordingly, rejected.
