JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 13-05-2016 Heard Mr. Sharda Nand Mishra for the petitioner and Mr. Amrendra Narain Rai who appeared on behalf of the respondent Bihar State Food and Civil Supplies Corporation ( for short Corporation').

Both the parties have agreed for disposal of the case.

The writ application prays for a direction upon the respondents to pay his retiral benefits as the petitioner superannuated from service of the Corporation on 31.8.2012. It is stated that upon retirement, he has been paid only part of the provident fund and pension. Other dues have not been paid. Mr. Mishra states that the petitioner would be

Patna High Court CWJC No.9141 of 2015 (2) dt.13-05-2016 2/2 satisfied if a liberty is granted to file a representation for payment of the remaining admissible retiral dues to the petitioner and the appropriate authority of the Corporation may be directed to examine the same and pass appropriate order. Mr. Rai considering the said stand of the petitioner has also agreed to the disposal of the writ application.

Consequently, the writ application stands disposed of permitting the petitioner to file a fresh application before the District Manager, of the Corporation ( respondent no.3) for payment of the remaining post retiral dues. If any such application is filed within four weeks the said respondent will consider/examine the same and take appropriate decision and/or pass appropriate orders towards payment/authorization of the remaining post retiral dues in favour of the petitioner as quickly as possible preferably within weeks of such filing/presentation.
