The petitioner seeks bail in connection with Sonbarsa P.S.Case No.34 of 2014 registered under Sections 364, 302, 34, 120(B) and 379 of the Indian Penal Code.
Petitioner is said to have hired the vehicle of the Manoj and that of the informant through the said Manoj for proceeding to Nepal. The Manoj regressed from Malangwa while the petitioner took the vehicle of the informant along with his driver and subsequently grabbed the said vehicle and eliminated its driver. It is submitted by learned counsel for the petitioner that petitioner had hired vehicle of the Manoj and that of the informant through said Manoj and went to Nepal along with his family and
Patna High Court Cr.Misc. No.52866 of 2017 (3) dt.12-12-2017 2/2 on arriving at the destination, he had released both the vehicles and he has neither any information about the subsequent development with the vehicle and the driver and nor any concern with the aforesaid occurrence. The petitioner has been languishing in custody since 05.06.2017. There is nothing cogent in the case diary indicating his complicity in the occurrence. Co-accused, Manoj Kumar, has been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No.24062 of 2014 vide order dated 02.08.2014.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Sitamarhi in connection with Sonbarsa P.S.Case No.34 of 2014.
