JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-05-2019 At the very outset, learned APP for the State has pointed out that in this case process under Sections 82 and 83 of the Cr.P.C. has already been issued against the petitioner which appears from the case diary.
Case in short is that the of the deceased was remarried with the petitioner and due to that he has committed suicide. Submission of learned counsel for the petitioner is that he is the second husband of the Neha Kumari, who was the wife of the deceased and for the marriage, he is not at all responsible.
Heard learned APP for the State.
Heard both sides, in view of the facts that the process under Sections 82 and 83 of the Cr.P.C. has already been issued against the petitioner, I am not inclined to grant anticipatory bail
Patna High Court CR. MISC. No.18571 of 2019(4) dt.17-05-2019 2/2 to the petitioner, however, if the petitioner pray for regular bail, the same shall be considered on the basis of materials available against him and after considering the same, the learned court below will pass an appropriate order being prejudice by order of this Court.
