JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-07-2023 The present writ petition has been filed seeking the following reliefs:- "1A(I). To pay to the petitioner the difference of salary to the tune of Rs. 5,56,066.00 with effect from 1.4.1997 to 30.6.2011 calculated on the basis of salary on account of 5th pay revision and the actual salary paid to the petitioner.

(II). To hold that the petitioner is entitled to the aforesaid difference of salary as the State of Bihar has already granted the benefits of 5th pay revision of scale to the

Patna High Court CWJC No.16772 of 2014(2) dt.20-07-2023 2/2 employees of Nagar Parishad with effect from 1.4.1997.

(III). To give such interest over the aforesaid amount to the petitioner as may be deemed fit and proper in the facts and circumstances of the present case.

(IV). To award appropriate cost of litigation payable to the petitioner as may be deemed fit and proper because after his retirement the petitioner has been forced to fight legal battle to receive his rightful claim on account of in action of the officials and office bearers of the Bettiah Nagar Parishad."

At the outset, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to pursue his subsisting grievances, if any, before the respondent authorities.

Accordingly, the present writ petition stands disposed off as not pressed.
