The petitioners, two in number, apprehend their arrest in a case under Section 323 and other sections of the Indian Penal Code and Section 3(x) of the SC/ST (Prevention of Atrocities) Act.
The informant alleged that the petitioners abused him by naming his caste and also assaulted him with fists and slaps. It is submitted that Manoj Kumar Singh lodged Bhagwanpur P.S. Case No. 150/2013 on 16.09.2013 and alleged that Sultan Paswan and others had demanded extortion and also assaulted the brother of Manoj Kumar Singh. The informant alleged that the occurrence took place on 16.09.2013 but the F.I.R. was lodged on 23.09.2013. Sri Ambika Bhagat, learned Spl. P.P. has vehemently opposed the prayer for anticipatory bail.

Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Begusarai in Begusarai SC/ST P.S. Case No. 165/2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
