Earlier thrice, the prayer for bail of petitioner was rejected. On last occasion, the prayer for bail was rejected, vide order dated 22.12.2021 passed in Cr.Misc. No. 62089/2021. In view of order dated 13.04.2022, supplementary affidavit has been filed on behalf of petitioner. Learned counsel for the petitioner submits that during trial, out of 15 charge-sheeted witnesses, 08 witnesses have already been examined and in their examination-in-chief, none of them supported the prosecution case and identified this petitioner. Petitioner is in custody since 30.08.2019, having no criminal antecedent.

Considering the period of custody undergone by the petitioner and deposition of witnesses, the bail petition of petitioner is allowed. Let the above named petitioner be released

Patna High Court CR. MISC. No.18630 of 2022(3) dt.27-04-2022 2/2 on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - 3rd, Sitamarhi in connection with Sessions Trial No. 85 of 2021, arising out of Dumra P.S. Case No. 91 of 2019.
